The Hawaii Supreme Court is not happy, and they are letting everyone know it. After getting shut down by the US Supreme Court over their bizarre "spirit of aloha" gun control arguments, the state’s top judges launched a massive, bitter attack on the federal judiciary in a recent ruling.

Let’s talk about the "spirit of aloha"

Not long ago, the Hawaii Supreme Court came up with a really weird way to interpret their state constitution. In a gun case called Wilson v. Hawaii, they basically said that under the spirit of aloha, you do not get to defend yourself with a firearm. They literally argued that carrying guns in public does not fit the traditional lifestyle of the islands.

Well, that did not sit too well with the US Supreme Court. In a later case, Woollard v. Lopez, which knocked down Hawaii’s strict limits on carrying guns in public, the high court openly mocked the state’s reasoning. The Supreme Court pointed out that federal rights do not bend to local vibes. The Second Amendment has the same meaning in Hawaii as it does in New York or Chicago, and it absolutely does not "give way to the spirit of aloha."

Needless to say, the judges in Hawaii got their feelings hurt.

A 15-page meltdown in a random case

Instead of taking their loss quietly, the Hawaii Supreme Court decided to lash out. They used a completely unrelated criminal case, Granillo v. State of Hawaii, to write a long, bitter essay complaining about the current US Supreme Court.

They openly declared that they were "untethered" from the Supreme Court’s analysis. Basically, they are trying to find any loophole they can to ignore the Second Amendment. This is not how our legal system is supposed to work. When the highest court in the land makes a ruling, state courts are supposed to fall in line. Instead, these judges are acting like angry bloggers.

Citing Dred Scott? Really?

To make matters worse, Hawaii’s justices tried to attack the idea of interpreting the Constitution based on its original meaning. But they did it in the most embarrassing way possible. They actually cited Dred Scott—the infamous pre-Civil War pro-slavery case—to make originalism look bad.

The National Firearms Act has been the law of the land for over 90 years, but things are shifting. Recently, the Second Amendment Foundation updated a major court filing in Texas, arguing that recent Supreme Court rulings have completely changed the rules for how federal gun laws should be viewed in court.

The shift in legal momentum

It feels like we’ve been waiting forever for some real teeth to be put into Second Amendment cases. While most folks are looking at the headline-grabbing stuff, there is a quiet but massive battle happening in a federal district court in Texas. The Second Amendment Foundation and the Silencer Shop Foundation put out a notice of supplemental authorities. When the government doxxes you, there is no hotline to call — and lately, there is another story about government overreach every time we turn around. This time, it hit home for a member of Gun Owners of America. In a move that feels like a total nightmare, the Department of Justice accidentally published a member’s private tax information in court.

The background of the mess

To understand why this is such a big deal, you have to look at why this person was filing paperwork in the first place. This started as part of a larger lawsuit against the DOJ and ATF regarding the registration requirements for items regulated by the National Firearms Act.

When this GOA member filled out their registration form, they hit a strange part of the process. In box 4i, the form asks why you want to make an NFA item. The member wrote, “To exercise my God-given rights.”

In fact, the ATF denied the application. This was important because the government claims the NFA is a “shall-issue” system—meaning they say it is just a minor hoop to jump through. By denying this form simply because the applicant stated, essentially, that they liked their rights, the member proved the government’s argument in court was totally wrong.

How the government doxxed a gun owner in public

While this legal back-and-forth was happening, the government made a massive, life-altering mistake. They filed the member’s form in a public court docket but failed to redact the sensitive information. They left the person’s full name, city, and state exposed for anyone to find.

To make matters worse, they also confirmed exactly how many regulated items the person owned. Essentially, they handed the public a map of a private citizen’s firearms collection. More importantly, this is not just a clerical error; it is a violation of federal law, as these forms are legally protected tax documents.
